Terms of use.

FM Alerts is a personal market-monitoring iOS app built and run by one person. These terms are written to be read — they cover your account, what you may do with the app and its data, and the honest limits of a signals tool.

The agreement

Downloading FM Alerts, creating an account, or using this website means you accept these terms. If they change materially, the effective date above changes and the difference is called out — never slipped in.

Who you're dealing with. FM Alerts — the iOS app, the backend, and fm-alerts.com — is built, operated, and supported by Francisco Mavungo. Questions and disputes go straight to the maker via the Support page, and almost always end there too.

You. An individual using the app for personal market monitoring. You must be able to form a binding agreement in your jurisdiction.

Apple's terms too. The app is distributed through the App Store, so Apple's standard Licensed Application End User License Agreement applies alongside these terms. Where they conflict, Apple's terms govern the App Store relationship.

Not financial advice — the line that matters most

FM Alerts surfaces market information. It does not tell you what to do with it.

Signals, pressure scores, futures flow, sentiment and alerts are informational — none of it is investment advice, a recommendation, or a solicitation to buy or sell anything.
The operator is not a broker, dealer, or registered investment adviser, and no fiduciary relationship is created by using the app.
Market data can be delayed, revised, or wrong; alerts can fire late or not at all. Never treat an alert as a trading instruction.
Trading involves substantial risk of loss. Every decision you make on the back of this app is yours alone — consult a licensed professional for advice on your situation.
FM Alerts never connects to a brokerage and cannot execute trades — by design.

Your account & acceptable use

One person per account. Access is granted per individual via access codes validated server-side. Keep your credentials to yourself; actions under your sign-in are treated as yours.

Market data is licensed, not owned. Prices, futures flow, and news arrive from licensed providers (Alpaca, Databento, Benzinga) for display to you personally. Scraping, redistributing, reselling, or republishing the data or alert streams isn't permitted — it would breach upstream licenses, not just these terms.

Fair use of alerting. Alert rules exist for personal monitoring. Automated abuse — hammering the API, scripting mass rules, probing the backend — is a fast way to lose access.

No reverse engineering. Don't decompile, tamper with, or attempt to bypass the app's authentication or the backend's controls.

Service & availability

As-is, best-effort. FM Alerts is provided as-is, without warranties of uninterrupted or error-free operation. Push and email delivery ride on Apple and AWS infrastructure and can be delayed by forces outside anyone's control.

Evolution. Features may be added, refined, or retired as the product grows; material removals are called out in the changelog, not hidden.

Live status. Current system health is always visible on the status page.

Liability & ending things

Liability, bounded. To the maximum extent the law allows, total liability for any claim is limited to what you paid to use FM Alerts in the twelve months before the claim — and never covers trading losses or indirect damages from decisions made with the app.

You leave. Stop using the app or ask for account deletion any time via the privacy process — honored without hoops.

Access ends. Accounts that breach these terms — data redistribution, abuse, tampering — can be suspended or closed; where the situation allows, a warning comes first.
